Welcome to the Magnum terms and conditions, which apply to all items ordered from https://shop.magnumicecream.com. Please read through them carefully before placing your order. By using this website and/or placing an order you agree to be bound by the terms and conditions set out below. Please also read our Privacy Policy regarding personal information provided by you.
These terms govern the sale by Unilever ("us") of the products to our customers ("you") through this website. When you purchase a product from us, you will be bound by these terms, the Terms of Use and the Privacy Policy for the website. If you do not accept the terms, you will not be able to purchase any products.
Only customers aged 16 or over may purchase products from this website: you will be asked to confirm your age when you check out.

Magnum is a brand owned by the Unilever Group, the parent company of which is Unilever plc, a company registered in England under company number 41424.
Unilever Foods & Refreshments Global B.V. (“Unilever”), also owned by the Unilever Group, a company registered in the Netherlands under company number 24152935, with its post address and its visiting address at Weena 455, 3013 AL Rotterdam, the Netherlands, is the owner and seller of the Magnum products offered on this website.
Unilever Europe B.V. (“Unilever Europe”), also owned by the Unilever Group, a company registered in the Netherlands under company number 67383033, with its post address and its visiting address at Weena 455, 3012 AL Rotterdam, the Netherlands, is the payment provider for the Magnum products sold on this website.
OUR PAYMENT PROVIDER
Unilever Europe is our payment provider – take payments for the products on our behalf. You may see their name (rather than ours) on your credit card or bank statement.
We will only be liable for the delivery of the products within 30 days after Unilever Europe has received your payment. Unilever Europe will not be liable for products defects and/or damages resulting from this.

OUR PRODUCTS
We offer you to buy mechanised Magnum products. It is only permitted to buy two items per order. The products are limited editions and will not be restocked. The website will indicate when the products are out of stock. Note that the delivery takes some days, and the delivery time may vary from country to country. Please find more information under ‘orders and delivery’.

HOW THE CONTRACT IS FORMED BETWEEN YOU AND US
When you place an order, you will receive an acknowledgement e-mail confirming receipt of your order. This email will only be an acknowledgement and will not constitute acceptance of your order. A contract between us for the purchase of the goods will not be formed until your payment has been approved by Unilever Europe and Unilever Europe have debited your credit or debit card.

PRICE AND PAYMENT
The prices shown on our website include any delivery charges and any VAT (or similar sales tax) at the prevailing rate for which we are responsible as the seller. The total amount you pay will be the price indicated on our website plus any delivery charges. The delivery charges will be shown during the checkout process.
All credit/debit cardholders are subject to validation checks and authorisation by the card issuer. If the issuer of your payment card refuses to, or does not for any reason, authorise payment then you will be notified of this immediately at the checkout stage.
In assessing your request for the purchase of the product(s), Unilever and Unilever Europe may use your information for the purposes of the prevention and detection of fraud. At all times where we or Unilever Europe disclose your information it will remain secure. If you believe your details are incorrect you may correct those details by following the procedure set out in our Privacy Policy.
HOW TO PAY
We accept Visa, Mastercard, American Express, Bancontact, Ideal, Apple Pay, Google Pay, Shop Pay and PayPal.
If you have paid on your credit or charge card you will be charged when the order is confirmed by the customer and check out is validated.
DONATION
Magnum does not only want to make you happy, but also wants to make a social contribution. Part of your payment will be donated to 100WEEKS. The amount donated by Magnum will be equal to the total proceeds of the sale of Magnum.
OUR LIABILITY TO YOU
The material displayed on this website is provided without any guarantees, conditions or warranties as to its accuracy. Unless expressly stated to the contrary to the fullest extent permitted by law, Unilever and its suppliers, content providers and advertisers hereby expressly exclude all conditions, warranties and other terms which might otherwise be implied by statute, common law or the law of equity and shall not be liable for any damages whatsoever, including but without limitation to any direct, indirect, special, consequential, punitive or incidental damages, or damages for loss of use, profits, data or other intangibles, damage to goodwill or reputation, or the cost of procurement of substitute goods and services, arising out of or related to the use, inability to use, performance or failures of this Website or the Linked Sites and any materials posted thereon, irrespective of whether such damages were foreseeable or arise in contract, tort, equity, restitution, by statute, at common law or otherwise.
This does not affect our liability for death or personal injury arising from its negligence, nor for fraudulent misrepresentation, misrepresentation as to a fundamental matter or any other liability which cannot be excluded or limited under applicable law.

If you breach these conditions and we take no action, we will still be entitled to use our rights and remedies in any other situation where you breach these conditions.
APPLICABLE LAW AND JURISDICTION
These terms and conditions are to be construed in accordance with the laws of the Netherlands and in the event of any dispute or claim associated with these terms and conditions, that dispute or claim shall be subject to the exclusive jurisdiction of the competent court in Rotterdam.
